On December 20, 1991, Congress passed the TCPA (Telephone Consumer Protection Act) in an effort to address a growing number of telephone marketing calls and certain telemarketing practices Congress found to be an invasion of consumer privacy. One section of the TCPA prohibits any calls made to cell phones from autodialers or by a prerecorded voice message unless the called party has given permission by "prior express consent" to allow receipt of such calls.
