REPRESENTATIVE LITIGATION EXPERIENCE

Over the past 20 years, Mr. Keegan has worked on numerous class actions, in which he acted as lead or co-lead counsel on behalf of a plaintiff class resulting in significant recoveries.  For example, Mr. Keegan has acted as co-class counsel and co-trial counsel, in a class action entitled Jason A. Park v. Cytodyne Technologies, Inc., Case No. GIC 768364, California Superior Court, San Diego County, (Judge Ronald L. Styn), asserting false advertising claims under the Unfair Competition Laws (California Business and Professions Code Sections 17200 and 17500) and the Consumer Legal Remedies Act (California Civil Code Section 1750).  In Jason A. Park v. Cytodyne Technologies, Inc., Mr. Keegan brought a successful motion for class certification and, along with his co-counsel, obtained a judgment of $12,536,820.00 in restitution and additional prohibitive injunctive relief on behalf of the certified class after a 7 week trial in 2003.

In addition to Jason A. Park v. Cytodyne Technologies, Inc., Mr. Keegan has acted as lead or co-lead counsel in the following cases on behalf of a plaintiff class resulting in significant recoveries:

Jason Baker has successfully litigated and/or acted as co-lead counsel on behalf of plaintiff classes in the following cases:

$18,080,742.14 in restitution, attorneys’ fees and costs, and additional prohibitive injunctive relief on behalf of the certified class after a 7 week trial asserting claims under the Unfair Competition Laws for false advertising (Business and Professions Code §§ 17200 and 17500).  [Jason A. Park v. Cytodyne Technologies, Inc., Case No. GIC 768364, [2003 WL 21283814], San Diego County.

$8,505,000 judgment on a cross-complaint against a partnership claim for fraud and breach of fiduciary duty. [The Premae Company, LLC v. Richard Doan, et. al Case No. 37-2012-00098024-CU-BC-CTL, San Diego County].

$5,000,000 class action settlement for employee class asserting violations of California’s Labor Code and the Unfair Competition Laws (Section 17200 of the Business and Professions Code).  [Wathik Sabri, et al. v. GMAC Mortgage Corporation, Case No. 03CC00423, Orange County].

$3,600,000 judgment against former controller for embezzlement and breach of fiduciary duty. [Basso Family Ventures, LLC v. Hanson-Cox, et. al Case No. 37-2013-00049158-CU-FR-CTL, San Diego County].

$3,200,000 class action settlement on behalf of class of employees in California asserting violation of California’s Labor Code and the Unfair Competition Laws.  [Aaron Lopez et. al. v. Fry’s Electronics, Inc., et. al, Case No. 1-06-CV-061162, Santa Clara County].

$2,150,000 settlement on behalf of a nationwide class of consumers based on claims of the Unfair Competition Laws for false advertising (Section 17200 of the Business and Professions Code). [Ko v. Natura Pet Products, Inc. Case No. 5:09cv02619, Northern District of California].

$2,000,000 class action settlement on behalf of the class of mortgage brokers in California asserting violations of California’s Labor Code and the Unfair Competition Laws.  [Lisa Hanna et al v. Home First Mortgage, et al Case No.SACV06-933, Orange County].

$1,484,268.89 judgment against a registered investment advisor on behalf of aggrieved investor for breach of fiduciary duty arising out of investment losses.  [Jeff Garcia v. Asset Strategies & Management, Inc., 111CV208986, Santa Clara County].

$950,000 settlement against the federal government for a motor vehicle accident with a traumatic brain injury. [Roberson v. United States, 02cv0078JM (JAH), Southern District of California]

$675,000 class action settlement on behalf of a nationwide class under the Telephone Consumer Protection Act. [Romero v. Collection Bureau of America, Ltd., case No. 37-2008-00090572-CU-MC-CTL, San Diego County].

$650,000 settlement in favor of an injured plaintiff arising from traumatic injuries resulting from inadequate bar/nightclub security. [Peltier v. Savanna Grill, Case No. 37-2011-00066106-CU-PO-EC, San Diego County].

$532,000 combined settlement in favor of minor shareholder plaintiff asserting violations of breach of fiduciary duty.  [Kreidman v. Reile, et al., Case No. 37-2010-00100462-CU-BC-CTL, San Diego County].

$515,000 class action settlement of on behalf of worker class asserting violations of California’s Labor Code and Unfair Competition Laws. [Hernandez et al v. Diamond Environmental Services et al, Case No. 37-2007-00051019-CU-OE-NC, San Diego County].

$450,000 class action settlement on behalf of class of mortgage brokers in California asserting violations of California’s Labor Code and Unfair Competition Laws. [Arthur Montalvo v. Lenox Financial Mortgage Corporation, et. al Case No. 06CC00249, Orange County].
